These Terms of Service ("Terms") are a legal agreement between you and Wakle ("we," "us," "our") governing your use of the Wakle mobile application and related services (the "App"). By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
The App is also subject to Apple's Standard End User License Agreement (EULA) for App Store applications. Where these Terms and Apple's Standard EULA conflict, Apple's Standard EULA governs for App Store distribution.
Wakle is an alarm app whose alarms end in a "mission" — a task you complete to dismiss the alarm — along with sleep tracking, a morning summary, wake-up streaks and reports, and optional social features for waking up alongside a partner or checking in on a family member.
Do not rely on Wakle as your only alarm for anything critical. Wakle depends on your device's operating system, notification permissions, battery state, Do Not Disturb and Focus settings, background-app limits, and other factors outside our control. Alarms can be delayed, silenced, or fail to fire entirely because of any of these. For situations where missing a wake-up has serious consequences — flights, exams, medical schedules, work shifts — you must use an additional, independent alarm. You are solely responsible for waking up on time. We are not liable for any consequence of an alarm not firing, firing late, or firing silently.
You may use the App with an anonymous session, or create an account with email, Google, or Apple sign-in. You are responsible for keeping your account credentials secure and for activity under your account.
You must be at least 13 years old to use the App.
You may delete your account at any time from within the App's settings. Deletion removes your profile, alarms, progress history, and any partner or caregiver links from our servers, subject to the retention described in our Privacy Policy.
What Pro unlocks: the Push-ups, Photo Match, Buddy Code, Wake Selfie, and Touch Grass missions. The rest of the App is free to use.
Auto-renewal: Wakle Pro is an auto-renewable subscription. Your subscription renews automatically at the end of each billing period (monthly or yearly, as selected) unless you cancel at least 24 hours before the period ends.
Payment: Payment is charged to your Apple ID account at purchase confirmation. All billing is handled by Apple through the App Store; we never receive or store your payment details.
Managing and cancelling: You manage or cancel your subscription in your device's App Store account settings, not within the App. Cancelling stops future renewals; it does not retroactively refund the current period.
Refunds: We do not process refunds directly. Refund requests are handled by Apple under the App Store's refund policy.
Price changes: If we change the subscription price, Apple will notify you and, where required, ask for your consent before the change takes effect. If you do not consent, your subscription will not renew at the new price.
Free trials (if offered): any unused portion of a free trial is forfeited when you purchase a subscription.
You agree not to:
Some features let you create content — a display name, reference photos for Photo Match (stored locally on your device), a Wake Selfie photo, and short messages or doodles to a linked partner. You retain ownership of your content. You grant us a limited licence to store and process it solely to provide the features it belongs to. You are responsible for the content you create and for ensuring you have the right to share it.
We may remove content or suspend access if content violates these Terms or is reported and found to be abusive. The App includes a reporting mechanism for user content in social features.
These features share limited information between two specific linked accounts, as described in our Privacy Policy. By linking with another person, you consent to that sharing. Eldercare features are consent-gated on both sides and can be revoked at any time. Do not use eldercare features as a substitute for appropriate medical care, monitoring, or emergency services.
The App, its design, its original content, and the Wakle name and logo are owned by us and protected by intellectual property laws. These Terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for personal, non-commercial purposes, in accordance with these Terms and Apple's Standard EULA.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, error-free, or that alarms will always fire as intended. Sleep scores, weather information, and other derived data are provided for general informational purposes only and are not medical, safety, or professional advice.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the App — including, without limitation, any consequence of an alarm failing to fire, firing late, or firing silently. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or USD 20.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.
You may stop using the App at any time and delete your account from within it. We may suspend or terminate your access if you materially breach these Terms, or if we are required to by law. On termination, your right to use the App ends; sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) survive.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Continued use of the App after a change takes effect means you accept the updated Terms.
These Terms are governed by the laws of India, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts located in Mumbai, India.
